Terms and Conditions

A successful Short Sale requires a lengthy and often frustrating negotiation which will not likely to be completed within the Refund Period.  I understand I must use the Refund Period to review the materials, procedures, rules, and my customer experience with your office and its staff to determine my satisfaction with the Service.  No refund will be issued due to unsuccessful resolution of Short Sale negotiations outside of the Refund Period.  All sales are final after the Refund Period and agree that I will not contact my credit card company regarding any returns, charge backs, or refunds.  Should you chargeback or dispute any charges made pursuant to this Agreement with your credit card company, a $50 chargeback processing fee will be billed to your card.  In the event the dispute or chargeback is determined to be valid, the chargeback processing fee will be refunded.

My monthly Service Maintenance fee of $197 will be charged to the credit card given for the initial order each month until such time as I provide you written notice of my desire to terminate my Active Key Holder status and at such time my monthly Service Plan will be stopped and my status made Inactive effective 30 days from receipt of my written notice.

I authorize The Short Sale Service, Inc. to use my success story in future marketing media.  I acknowledge that The Short Sale Service, Inc. does not function as my real estate broker, personal accountant, attorney or financial advisor. If I have a tax or legal question, I will seek the advice of an accountant, attorney, financial advisor or real estate broker. 

I acknowledge that I am responsible for my actions and hereby release The Short Sale Service, Inc. and any of its staff, employees, officers or affiliates from liability for any of my actions or comments influenced by the information contained in products and services received.  From this day forward, I assume full responsibility of my personal, physical, emotional and financial wellbeing.

I understand providing the information on this form gives The Short Sale Service, Inc. permission to communicate with me by fax, email, or phone to relay special offers, announcements and other information.  I understand I will receive confidential information that may not be shared with anyone.  I will not reproduce these copyrighted materials nor lend, rent, or sell them to anyone to remain in compliance with the federal and state copyright and trademark laws.

I acknowledges and agrees that the Service consists of general consulting and negotiating and does not constitute the practice of law or the giving of legal opinions and that neither The Short Sale Service, Inc., The Pargman Law Firm, Inc., nor Benjamin C. Pargman nor any employees, representatives, or agents thereof shall be deemed to be engaged in the practice of law or the rendering of legal services or opinions with respect to the Service and the work contemplated hereunder.  I further acknowledges and agrees that these services are rendered in an arms-length relationship, no fiduciary relationship is created and is expressly disclaimed and the protections of the client-attorney relationship do not exist unless a written “Engagement Letter for Legal Services” is entered into specifically creating the attorney client relationship.  Neither The Short Sale Service, Inc., The Pargman Law Firm, Inc., nor Benjamin C. Pargman shall serve or be deemed to have served as a closing agent or title insurance agent, nor shall any of these parties advance funds, initiate wire transfers or in any way hold, transfer or collect any funds associated with any real estate transaction, Short Sale, loan payoff or otherwise whatsoever other than fees paid directly to The Short Sale Service, Inc., the Pargman Law Firm, Inc. or Benjamin C. Pargman for services contemplated in this Agreement by said party.

I agree to inform Seller that the Service will not be rendering legal services to Sellers, that the services do not constitute the practice of law or the giving of legal opinions and that neither The Short Sale Service, Inc., the Pargman Law Firm, Inc., nor Benjamin C. Pargman, nor any employees, representatives, or agents thereof shall be deemed to be engaged in the practice of law or the rendering of legal services or opinions with respect to the Service and the work contemplated hereunder.  I further agree to inform Sellers that these services are rendered in an arms-length relationship, no fiduciary relationship is created and is expressly disclaimed and the protections of the client-attorney relationship do not exist unless a written “Engagement Letter for Legal Services” is entered into specifically creating the attorney client relationship.  Key Holder further agrees to obtain a written acknowledgement and agreement from Seller containing these terms.

I will NOT refer to the Short Sale Service as “my law firm” nor will I refer to Mr. Pargman as “my lawyer”. I hereby acknowledge and agree that real estate investment is fundamentally a speculative activity and that no guarantees or promises as to financial success or investment returns have been made to me by The Short Sale Service, Inc., Benjamin C. Pargman, or any combination thereof.  I hereby indemnify and hold The Service, Benjamin C. Pargman and any agent or representative working by or on behalf of The Service and Benjamin C. Pargman harmless from any and all losses and damages suffered by me or Seller or me and Seller or any other party including but not limited to real estate agents, brokers, auctioneers, appraisers, title insurance companies, closing agents, attorneys, or any other party who may be involved with the transaction between Seller and me or with the Property as a result of a foreclosure of the Property, the Short Sale, the Service, a Workout, any investment decisions regarding the Property, or otherwise associated with this Agreement for any reason whatsoever.
